Schlachter: An existing gazebo was built 2.5 ft off property line but required to be 5 ft based on its size. The pool was previously approved within 10 ft of sewer & should have been 20 ft. This brings this into compliance. HOA has seen and also approved.
(I1a2) RZ25-11-03, Rezoning from R-A (Residential Agricultural) to S-1 (Special), 5385 Washington Road, Tax Map 058 Parcels 218B, 218C & 218D, 12.54 +/- acres combined, and currently zoned R-A (Residential Agricultural). Disapprove: Yay 5, No 0
Schlachter: Applicant wants to use this as parking lot for RVs, trailers, etc. Something usually in a C3 or light industrial. Applicant stated this is for transitional use until property gets sewer, then do something different long term. Staff recommnds disapproval.

Article IV Supplemental Requirements, Section 90-139 Buffers and screening, and Section 90-147 Use provisions. – First Reading
S Johnson: Rezoning classification. This is first Reading and will require 2nd reading if passed 1st reading tonight. Aimd at data center development as that’s been a big issue in our community for awhile now. Looked at other zoning ordinances in other jursitictions, traveled to other places, and seen problems other people have had, and take that into consideration. Looked at public input. One of the more stringent ones we’ve seen. Nobody will be happy with everything. This creates data center zoning. We want all data centers to fall under this. It has very specific uses, specific lot requirements, such as building heights. Buffers probably one of the the biggest things. Buffers more stringent than other zoning, especially residential. Additional use provisions, sound restrict of 70 decibels. That’s about a normal conversation. How generators can b tested/used, lighting, prohibition of wells - tapping into acquiffer, fencing and parking/landscaping, that kind of thing. Staff didn’t go into this lightly. Took a lot of time & effort to creating zoning ordinance. Took into consideration public feedback.
Melear: Can you go into the 1st reading, 2nd reading timeline?
Johnson: Any change in ordinances requires 2 readings. This is a 1st reading. If approved tonight, the 2nd reading will be at the next commission meeting and final reading & vote. Rezoning applications after that goes into effect. No right to do anything tonight. Each zoning zoning decision will be heard at a later date. 1st, 2nd reading then ordinance, then application for Rezoning, property posting, planning commission approval, Board of Commission approval before anything can move.

Schlachter: This is from Helene damage. Sure that they might run into problems when they start repairs so increased budget. Reimbursable from FEMA.
